Executive Summary: TopAI Gateway provides deterministic, sub-30ms Edge AI gateway micro-services. All commercial order processing, payments, VAT collection, and billing invoicing are legally operated by Polar Software Inc. (Polar.sh) acting as the exclusive Merchant of Record (MoR).

1. The Service Provider & Operating Entity

The technical platform, application programming interfaces, and deterministic micro-services accessible at topaigateway.com (and related endpoints including topaimcp.com) are operated by TopAI Gateway (managed by the TopAI Architecture & Governance Board).

2. Merchant of Record (MoR) & Payment Processing

All subscriptions, commercial checkout links, digital licensing, and recurring payments for TopAI Gateway (Pack 1, Pack 2, Pack 3, and Pack 4) are processed exclusively by our authorized Merchant of Record:

Merchant of Record Entity: Polar Software Inc. (operating via polar.sh).
Legal Status: Polar Software Inc. is the contractual seller of record to end customers for digital goods, providing global tax compliance (including EU VAT, UK VAT, and US Sales Tax).
Customer Invoices: Official receipts and tax-compliant VAT invoices are issued directly to buyers by Polar Software Inc.

3. Free Evaluation Tier & Sandbox Quotas

TopAI Gateway offers a Free Evaluation Tier providing up to 100 requests per month across certified endpoints. This allows enterprise engineering teams to benchmark latency, deterministic routing, and anti-SSRF protections prior to purchasing a commercial subscription pack. No credit card is required to activate an evaluation key.

4. Subscription Packs, Quotas & Fair Use

TopAI Gateway operates on flat-rate cumulative subscription packs without hidden per-token markup:

Pack 1 (DevEx & FinOps): 10,000 requests/month · 120 requests/minute.
Pack 2 (Squad Velocity): 50,000 requests/month · 600 requests/minute.
Pack 3 (High-Scale & Infra): 250,000 requests/month · 2,400 requests/minute.
Pack 4 (Sovereign Enterprise): 1,000,000 requests/month · 6,000+ requests/minute.

5. EU DORA Directive (2022/2554) & Regulatory Alignment

In accordance with Regulation (EU) 2022/2554 (Digital Operational Resilience Act - DORA), TopAI Gateway provides immutable cryptographic audit logs for enterprise tiers, multi-region Cloudflare Anycast fallback, zero vendor lock-in, and sub-30ms performance guarantees.
